1. INTRODUCTION
Irina Taneva Iri IR is registered as a Sole Trader in England, trading as Irina Taneva, owns and operates the Website https://irinataneva.com/. Irina Taneva Iri IR (“she”, “her”, “artist”) is an artist, designer, art and design teacher, and organiser of classes and workshops.
Please read these terms and conditions carefully before using this website, purchasing original art work, prints, and other products, making bookings for in-person or online private lessons or classes, and participating in painting workshops. By visiting this website and engaging with the content, you accept and agree to be bound by these Terms. If you disagree with any part of the Terms and Conditions, then you should stop using this website immediately.
2. GENERAL
2.1. You may not transfer any of your rights under these terms and conditions to any other person. Irina Taneva may transfer her rights under these terms and conditions where she reasonably believes your rights will not be affected.
2.2. These terms and conditions may be modified by Irina Taneva from time to time. Such revised terms will apply to the Website from the date of publication. You should check the terms and conditions regularly on the website to ensure familiarity with the current version.
2.3. These terms and conditions, together with the Privacy Policy contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.
2.4. This Agreement shall be governed by and interpreted according to the law of England and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English courts.
2.5. Nothing contained in any Contract is intended to be enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999 by any third party.
3. INTELLECTUAL PROPERTY AND ACCEPTABLE USE
3.1. All Content included on the Website is the property of Irina Taneva, her affiliates or other relevant third parties.
3.2. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer, laptop, tablet or a phone, that appears on or forms part of this Website, including any such content uploaded by relevant third parties.
3.3. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, design rights, database rights and other intellectual property rights (registered and unregistered). Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission.
3.4. You may, for your own personal, non-commercial use only, do the following: retrieve, display and view the Content on a screen.
3.5. You must not otherwise reproduce, modify, copy, distribute, transmit, display, perform, publish, license, create derivative works form, transfer, sell or use for commercial purposes any Content from this website without the written permission of Irina Taneva.

4. PROHIBITED USE
4.1. You may not use the Website for any of the following purposes:
4.1.1. In any way which causes, or may cause, damage to the Website or interferes with any other person’s use or enjoyment of the Website;
4.1.2. In any way which is harmful, unlawful, illegal, abusive, harassing, threatening or otherwise objectionable or in breach of any applicable law, regulation, governmental order;
4.1.3. Making, transmitting or storing electronic copies of Content protected by copyright without the permission of the owner.
4.2. You must not post onto or transmit to Irina Taneva Iri IR’s website any material containing software viruses or files which may damage or disrupt the good working order of computer or telecommunications equipment.
4.3. Link backs to this website are allowed, as long as you inform the artist in advance, clearly credit this website and provide a hyperlink back to this website.
4.4. Irina Taneva Iri IR may record, preserve, trace and disclose anything which has been transmitted to from or via this website, where required by law, or where the user is acting in good faith.
4.5. If you create or are provided with a username, password or any other piece of information as part of the security procedures, you must treat this information as confidential. In particular, you must not disclose this information to any third party.
5. WEBSITE CONTENT, AVAILABILITY AND DISCLAIMERS
5.1. Any online facilities, products, services or information that Irina Taneva makes available through the Website, is provided “as is” and on an “as available” basis. The artist gives no warranty that the products or services will be free of defects and/or faults. To the maximum extent permitted by the law, she provides no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
5.2. Occasionally there may be information on this website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability; as well as classes and workshops descriptions, pricing, promotions, offers, bookings and availability.
5.3. Irina Taneva reserves the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the website is inaccurate at any time without prior notice (including after you have submitted your order).
5.4. Whilst Irina Taneva uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, the artist gives no warranty or guarantee in that regard and you take responsibility for your own security, that of your personal details, computers and other devices.
5.5. Irina Taneva reserves the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, any products and/or services available. These terms and conditions shall continue to apply to any modified version of the Website unless it is expressly stated otherwise.
6. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
6.1. The services and all products delivered to you through the service are (except as expressly stated by the artist) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
6.2. Irina Taneva does not guarantee, represent or warrant that your use of her service will be uninterrupted, timely, secure or error-free.
6.3. Irina Taneva will not be liable to you in respect of any losses arising out of events beyond her reasonable control.
6.4. You expressly agree that your use of, or inability to use, the service is at your sole risk.
6.5. To the maximum extent permitted by law, Irina Taneva accepts no liability for any of the following:
6.5.1. Any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, and goodwill or commercial opportunities;
6.5.2. Loss or corruption of any data, database or software;
6.5.3. Any special, indirect or consequential loss or damage.
7. PRODUCTS AND SERVICES
7.1. Certain products or services may be available exclusively online or exclusively in-person through the website. Irina Taneva makes every effort to display as accurately as possible the colours and images of her products that appear on the website. The artist cannot guarantee that your monitor’s display of any colour will be accurate.
7.2. Irina Taneva reserves the right, but is not obligated, to limit the sales of her products or services to any person, geographic region or jurisdiction. The artist may exercise this right on a case-by-case basis.
7.3. The artist reserves the right to limit the quantities of any products or services that she offers.
7.4. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of the artist.
7.5. Irina Taneva reserves the right at any time to modify or discontinue products and services (or any part or content thereof) without notice at any time.
7.6. Irina Taneva shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of any products or services.
7.7. Irina Taneva does not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.
8. PURCHASING ARTWORKS
8.1. You can purchase any original painting displayed in the website’s galleries that has a price and is in stock. Please email Irina Taneva Iri IR at art@ irinataneva.com with the name of the painting to place an order.
8.2. You can ask to order a print of any original painting you like from the galleries at a much affordable price. Please email Irina Taneva Iri IR at art@ irinataneva.com to enquire.
8.3. All original paintings will be accompanied with a Certificate of Authenticity.
9. SHIPPING OF ARTWORKS
9.1. Your original painting will be packed and shipped within 3 days after the payment is received, via Signed 1st class service with Royal Mail, DPD or Parcelforce couriers. Your signature will be required to receive the painting.
9.2. Please allow 7 working days for printed artwork to be shipped after the payment is received, due to the extra time needed for printing. The print will be shipped to you via Signed 1st class service with Royal Mail. Your signature will be required to receive the print.
9.3. Deliveries are made Monday to Friday. Original paintings are shipped to UK customers only for now. Prints can be shipped worldwide.
10. RETURNS AND REFUNDS OF ARTWORKS
10.1. Irina Taneva Iri IR accepts returns on original paintings only. Upon receiving your order, you have 2 days to contact the artist for a refund minus shipping costs.
10.2. The artist has to receive back the original painting in a perfect condition and without any defects within 14 days of delivery, for you to be issued a refund. You have to dispatch the painting back in the original packaging you have received it, via Signed 1st class service with a courier or Royal mail.
10.3. You should expect the funds back within 5 working days of receiving the shipment of the original painting.
10.4. Customised orders, prints, and digital products are non-refundable.
11. BOOKING PROCESS FOR LESSONS, CLASSES AND WORKSHOPS
11.1. Bookings for individual lessons and group classes, private workshops and corporate team building workshops, in-person or online, can be made by e-mailing Irina Taneva Iri IR at art@ irinataneva.com directly, or if there is a link for a payment provided.
11.2. The person, who makes the booking for a private or a corporate team building workshop, is responsible to communicate with all participants, organise their attendance, accepts these Terms and Conditions on their behalf, and is responsible for the payment.
12. PRICES
12.1. Irina Taneva offers different lessons, classes and workshops based on different themes, skill levels, techniques, types of length and experiences, etc., therefore there are different price ranges.
12.2. The prices for individual private lessons, group classes, and bundles are clearly marked on the page of art classes on the website https://irinataneva.com/art-classes Irina Taneva reserves the rights to change these prices regularly and without notice. Please check the prices on the website before booking.
12.3. The prices for private workshops and corporate team building workshops are negotiated on an individual basis depending on the venue and the number of the participants. The price is determined for a minimum of 10 participants in a workshop. Workshops for less than 10 participants will be organised, but a flat price for 10 participants will be charged. Should you wish to add on any additional participants to the workshop after the invoice has been paid, the cost will be the same price per head as the original booking. The duration of private workshops and corporate team buildings is 2 hours, unless negotiated and paid in advance for a longer session.
12.4. All basic materials needed for each private lesson, group class or workshop are included in the price. They depend on the theme and the chosen medium for the specific lesson or workshop. This includes in most cases brushes, paper or canvas, pencils, rubbers, paints, tissue napkins, pallets, aprons, etc. Some workshops could include other materials, depending on the theme and the technique planned.
13. PAYMENTS
13.1. Irina Taneva takes full payment in advance to secure your booking for all individual lessons, group classes, private and corporate workshops.
13.2. Irina Taneva Iri IR accepts Bacs payments, via direct bank payment link, or PayPal link, so you can safely make your payment.
13.3. Payments over the phone are not accepted. The artist doesn’t take any credit or debit card information, therefore she doesn’t store this type of information.
14. CANCELLATIONS AND REFUNDS
14.1. Cancellation and refund of individual bookings, group classes and bundles
14.1.1. Your place in a private individual or a group class lesson is reserved just for you. A late cancellation, or a missed lesson, leaves an empty place that could have been filled by another student. As such, please email art@ irinataneva.com 48 hrs in advance for any cancellations or changes to your booking. Students that provide less than 48 hrs notice, or miss their class, will not be refunded, and their lesson will not be rescheduled.
14.1.2. Bundle purchases are not refundable. Booked classes can be rescheduled if requested at least 48 hrs prior the class, if any dates and places are available, and within the length of the purchased bundle (bundle for 1 month or bundle for 3 months).
14.2. Cancellation and refund of private and corporate team building workshops
14.2.1. If you need to cancel your private or corporate team building workshop, unfortunately Irina Taneva cannot offer a refund, but the artist will try her best to rearrange your workshop to a different date, however a rescheduling fee will apply.
14.2.2. If the number of people attending the private or the corporate team building workshop decreases after payment has been made, unfortunately Irina Taneva cannot offer refunds for those unable to attend.
14.3. Cancellations and Refunds from the side of Irina Taneva Iri IR
On very unlikely or unpredictable occasions Irina Taneva Iri IR may need to cancel a lesson, group class or a workshop, due to unexpected circumstances. In that case, she will offer to transfer the booking for another date or a full refund.
15. THIRD-PARTY LINKS
Certain content, products and services available via the website may include materials from third-parties. Third-party links on this site may direct you to third-party websites. Irina Taneva is not responsible for examining or evaluating the content or accuracy and she does not warrant, and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
16. TERMINATION
16.1. The obligations and liabilities of the parties, incurred prior to the termination date, shall survive the termination of this agreement for all purposes.
16.2. These Terms and Conditions are effective unless and until terminated by either you or Irina Taneva. You may terminate these Terms of Service at any time by notifying the artist that you no longer wish to use her services, or when you cease using her site.
16.3. If in Irina Taneva’s sole judgment you fail, or she suspects that you have failed, to comply with any term or provision of these Terms and Conditions, she also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to her products and services (or any part thereof).
